These Terms & Conditions ("Terms") govern your access to and use of the 90heal mobile application ("App"). By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using the App.
1.1 Eligibility: The App is designed for use by undergraduate engineering students in India. By using the App, you confirm that you are enrolled in an engineering program and are eligible to use the App as per these Terms.
1.2 Subscription and Access: Your access to the App is provided through a subscription by your college for the duration of your enrollment. Upon your disassociation from the college (e.g., graduation, transfer, or other reasons for discontinuation), your access to the App will be terminated. Post-termination, you may subscribe as an individual user to continue using the App. For subscription details, please contact us at team@90heal.com.
1.3 Parental Consent: A parental consent form is sent to your parents by your college administration. It is assumed that this form has been duly acknowledged and consented to by your parents before you log in to the App. By using the App, you confirm that such consent has been obtained.
2.1 Data Collection and Storage: The App collects certain identifiable information tied to your email address, including your gender, current college enrollment, education branch, year, and semester details. This information is collected solely for the purpose of providing you with a personalized experience and ensuring the effective operation of the App.
2.2 Anonymous Data Processing: Except for the aforementioned identifiable information, all other data that you input into the system or receive from the system is processed anonymously. This means that such data will not be linked to your personal identity.
2.3 Data Security: We employ industry-standard security measures to protect the integrity and confidentiality of your data. However, while we strive to protect your data, we cannot guarantee absolute security, and you acknowledge that you use the App at your own risk. In the event of any data breach, we will comply with the applicable legal obligations under Indian law.
2.4 Use of AI Tools: The App incorporates generative AI tools, for the creation of content and interactive features. These tools are intended to provide helpful and accurate information, but they do not replace professional advice or treatment.
3.1 No Professional Advice: The App provides tools and resources designed to assist in managing mild to moderate mental health issues such as study stress, test anxiety, career anxiety, interpersonal relationship stress, and procrastination. However, the content provided through the App is for informational purposes only and does not constitute professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition.
3.2 Emergency Situations: The App is not designed to handle emergency situations. If you are experiencing a mental health crisis, please contact local emergency services or visit the nearest healthcare facility immediately.
3.3 Limitation of Liability: To the maximum extent permitted under Indian law, 90heal, its affiliates, and licensors shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, arising out of or related to your use of the App. Our liability for any direct damages shall be limited to the amount you have paid, if any, for the subscription to the App.
4.1 Ownership: All intellectual property rights in the content available on the App, including but not limited to text, graphics, images, videos, software, and any content generated using AI tools such as ChatGPT and DALL-E, are owned by 90heal or its licensors. You may not reproduce, distribute, modify, or create derivative works from this content without our prior written consent.
4.2 Third-Party Intellectual Property: The App may use third-party intellectual property, such as the Psychological Assessments and Syncfusion Charts, under appropriate licenses. You agree to comply with all applicable third-party terms and conditions.
5.1 Prohibited Activities: You agree not to engage in any activities that could harm, disrupt, or negatively affect the App or its users. Such activities include, but are not limited to, hacking, transmitting malware, spamming, or engaging in any unlawful activities.
5.2 Content Standards: When using any interactive features of the App, such as chatbots, you agree to maintain respectful and appropriate communication. The use of offensive, defamatory, or otherwise inappropriate language is strictly prohibited.
6.1 Amendments: We reserve the right to modify these Terms at any time. Any changes will be posted on the App, and your continued use of the App after such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
7.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
7.2 Jurisdiction: Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in [Hyderabad], India.
7.3 Dispute Resolution: In the event of a dispute, the parties agree to first attempt to resolve the matter amicably through mutual discussion. If the dispute cannot be resolved amicably, the parties agree to submit the matter to mediation before pursuing any legal action.
8.1 Termination by 90heal: We reserve the right to suspend or terminate your access to the App at our sole discretion, with or without notice, if you violate these Terms or for any other reason deemed appropriate by us.
8.2 Termination by You: You may terminate your use of the App at any time by uninstalling the application from your device. Upon termination, all rights granted to you under these Terms will cease.
